Privacy Policy
1 Purpose
1.1 The Protection of Information Policy (the Policy) details Bluewater’s (The Bluewater/Bluewater/we/us) commitment to a culture that protects privacy and the personal information it collects, stores, discloses and uses and outlines how Bluewater will adopt best practice in the management of personal information.
2 Definitions
2.1 Access means providing to an individual, information about themselves that is held by Bluewater. This may include allowing that individual to inspect personal information or to obtain a copy;
2.2 Collection means gathering, acquiring or obtaining personal information from any source and by any means, including information Bluewater has come across by accident or has not asked for;
2.3 Consent means voluntary agreement to some act, practice or purpose;
2.4 Disclosure means the release of information to persons or organisations outside Bluewater. It does not include giving individuals information about themselves;
2.5 Personal Information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about a natural living person whose identity is apparent, or can reasonably be ascertained, from the information or opinion, including a photograph or other pictorial representation of a person;but does not include information that is:
- in generally available publications;
- in material kept in public records and archives such as the Commonwealth or State archives; or
- in anything kept in a library, art gallery or museum for the purpose of reference, study or exhibition.
2.6 Privacy Act means the Privacy Act 1988;
2.7 Sensitive Information means information or an opinion about an individual’s
- racial or ethnic origin;
- political opinions;
- membership of a political association, a professional or trade association or a trade union;
- religious beliefs or affirmations;
- philosophical beliefs;
- sexual preferences or practices;
- criminal record;
- health; or
- any other information a reasonable person would consider to be private
2.8 Use means the handling of personal information within Bluewater including the inclusion of information in a publication.
3 Scope
3.1 The Policy covers all Bluewater departments.
4 Legislative and Corporate Requirements
4.1 The Privacy Act sets out the principles, which must be followed by Commonwealth Government agencies and many private organisations in relation to the collection, maintenance and use of personal information.
4.2 The provisions of the Privacy Act do not apply to Bluewater. However, in collecting, using, storing and disclosing personal information, Bluewater acknowledges the Australian Privacy Principles contained within the Privacy Act set an appropriate standard for privacy protection and the Policy is intended to achieve “best practice” consistency with those standards.
5 Policy Statement
5.1 It is Bluewater policy to have in place adequate systems of internal controls, which promote a high level of integrity in protecting personal information.
These controls over personal information relate to:
- Collection and use of personal information
- Distribution of personal information
- Maintenance and storage of personal information
- Disability claims and financial hardship applications
- Access to personal information
- Suppression of personal information
6 Collection and Use of Personal Information
6.1 All personal information collected by Bluewater is to be used only for the purpose of conducting business in accordance with the provision of Bluewater services.
6.2 The type of personal information collected and held will depend on the services provided, but may include:
- Telephone numbers
- Name and address (postal, residential, and email addresses)
- Age &/or date of birth
6.3 All information will be collected in a fair and lawful manner and as required/permitted by legislation. Bluewater is committed to ensuring individuals are aware of the purpose of collection of the information and aware that the collection is authorised or required by law.
6.4 In satisfying the collection and use of personal information obligations, Bluewater assumes that:
(a) any personal information provided is free from errors and omissions, is not misleading or deceptive and complies with all relevant laws; and
(b) individuals have the necessary authority to provide any personal information submitted to Bluewater;
6.5 It is the responsibility of individuals to provide Bluewater with details of any changes to their personal information as soon as reasonably practicable.
6.6 Bluewater will make every effort to ensure that its records of an individual’s personal information are up to date and accurate.
6.7 Bluewater does not track individuals Internet activity when they visit Bluewater’s web site. Bluewater will only collect an individual’s email address to respond to their enquiry if they choose to contact Bluewater via the Internet.
7 Distribution of Personal Information
7.1 Bluewater will not provide personal information it holds on individuals to third parties, except:
7.1.1 where the individual has made a written request for personal information to be provided to a third party;
7.1.2 where the provision of personal information is for the purpose of distributing materials for the sole purpose of and on behalf of Bluewater
7.1.3 where Bluewater is required by legislation to provide personal information to a third party
7.1.4 where the individual has been advised of Bluewater’s usual practice of disclosing personal information to that third party or a third party of that type for a particular purpose and the disclosure is consistent with that purpose.
7.2 Before Bluewater will provide personal information to a third party service provider that is subject to the provisions of the Privacy Act, that supplier will be required to provide a signed Privacy Undertaking to Bluewater that it will comply with the Privacy Act and the Australian Privacy Principles in respect to the collection, use and handling of personal information supplied by Bluewater.
7.3 Bluewater may supply personal information about an individual as part of a standard communication or pursuant to a request made by that individual.
7.4 Bluewater does not accept any responsibility for any loss or damage suffered by individuals because of their reliance on any personal information provided to them by Bluewater or because of Bluewater’s inability to provide individuals with any requested personal information.
8 Maintenance and Storage of Personal Information
8.1 Bluewater will take reasonable steps to protect the personal information it holds from loss, unauthorised access, use, modification, disclosure and other misuse, and to maintain systems to ensure that all personal information collected is up to date, accurate and complete.
9 Access to Personal Information
9.1 Individuals who wish to access the personal information Bluewater holds in relation to them can do so by contacting Customer Services staff. These requests will be dealt with as soon as is reasonably practicable, having regard to the nature of the information requested. The person making the request will need to satisfy Customer Services Staff as to their identity.
9.2 If an individual can show that the personal information held by Bluewater is not accurate or complete, it will be amended by Customer Services staff.
10 Complaints
10.1 Individuals who have any concerns regarding how Bluewater handles personal information, or require further information should contact Bluewater in the first instance.
10.2 If Customer Services staff cannot satisfy the individuals concerns, the individuals may lodge a formal complaint. Complaints should be made in writing to:

11 Review
11.1 The Policy will be reviewed as required by Bluewater or as required by legislation.

BLUEWATER INFORMATION COLLECTION
STATEMENT – COMPETITIONS
(required under Australian Privacy Principle (“APP”) 5)
Bluewater Hotel Pty Ltd trading as Bluewater Bar and Grill (ABN 127 353 36727) (“Bluewater/we/us”) will collect, store and use the personal information you have provided to us pursuant to the terms of this Collection Statement and our Privacy Policy.
1 Uses of your personal information
The primary purpose for which Bluewater is collecting your personal information is to manage and facilitate the competition you have entered.
You agree that we may also use your personal information for related secondary purposes including:
- communicating with you, including by email, mail or telephone;
- performing research and analysis aimed at improving our products, services and technologies;
- sending marketing and promotional material about our products and/or services (or the products and/or services of our Related Bodies Corporate) that we believe you may be interested in;
- or purposes otherwise required or permitted by law (including the Privacy Act); and
- for any other purpose as expressly listed in our Privacy Policy.
If you do not provide us with the personal information we ask for or the information provided is incorrect or incomplete, we may not be able to allow your entry into the competition.
2 Disclosures of your personal information to third parties
We may disclose your personal information (such as your name, email address and telephone number) to the following organisations for the purposes described above (as well as otherwise permitted or required under Australian law):
- Bluewater’s Related Bodies Corporate as applicable
- Bluewater’s agents and other third parties contractors who carry out functions on our behalf;
- organisations wishing to acquire an interest in any part of Bluewater’s business for assessing or implementing any such acquisition;
- third party clients/partners of Bluewater’s whom you have opted-in to allowing Bluewater to disclose your personal information to; and
- any other organisation as expressly covered in our Privacy Policy.
3 Bluewater’s Privacy Policy

- how you may access or correct any of your personal information collected by Bluewater; and
- how you may lodge a complaint with Bluewater for a breach of any APP or APP code,
and how Bluewater will action such complaint.

Bluewater Bar & Grill Bus Guidelines
We are committed to providing our guests with ongoing clean safe facilities with a high standard of service and support to our community.
The Bluewater Bar & Grill are also committed to providing a safe working environment. The Management wish to advise the Bluewater Bar & Grill Provides a COURTESY BUS and therefore cannot guarantee that all patrons wishing to use the service will be picked up and delivered to the venue in the time frame that they may require. Management reserves the right to refuse admittance to the Courtesy Bus to any guests.
- ONLY Children over the Age of 8 are permitted on the Courtesy Bus
- No Booster seats are NOT provided
- No alcohol, drinks or food are to be consumed on the Courtesy Bus
- Guests are only to be picked up if attending the Bluewater Bar and Grill
- Guests are not permitted on the Courtesy Bus without the authorised Bus Driver
- Guests will NOT be dropped off to any other licensed premised under any circumstances
- Guests must contact The Bluewater directly to advise they wish to be picked up and dropped off by the Courtesy Bus by giving their phone number, address and number of passengers
- Maximum courtesy Bus capacity is 11 guests
- Disorderly guests will not be permitted to board the bus
- Pick-ups and drop-off will be completed at the discretion of the Driver on Duty and Bluewater Management
- If a guest soils the bus a $50 cleaning fee will apply
- The bus will not enter unit complexes Patrons must wait at the front of the complex and will be dropped back to the front of the complex

Bluewater Wedding and Events Terms and Conditions
1 Booking Confirmation:
The Bluewater Bar & Grill requires a deposit of $1500.00 to confirm wedding bookings. Other events will require a $500 deposit or as negotiated with the Events Manager. Unsecured bookings will only be held for 7 days unless otherwise organised. The deposit amount will be deducted from your total bill on the day of your function.
2 Booking Agreement:
Confirmation of bookings is required in writing, Any tentative booking not confirmed with in two weeks of the enquiry may be released at the discretion of Bluewater Bar & Grill management.
Deposit can be made by EFT(BSB. Acct. Mi,ber and reference will be sent via email) or via credit card (MasterCard and VISA or AMEX [INCURS 2% surcharge]) or in-person to the Events Manager at The Bluewater.
3 Number of People
The final number of guests to attending your function is final and required to be confirmed seven [7] days prior to the confirmed event date. Weddings require final numbers to be confirmed fourteen [14] days prior to confirmed date.
We will accommodate reasonable changes where possible, however if we are unable and should the numbers decrease by more than 10% a $20 per head cancellation fee will retained. Should the numbers increase, payment will be required for all guests attending your function.
4 Food and Beverage:
All menus are required to be confirmed no less than fourteen [14] days prior for all weddings and no less than seven [7] days prior for other events or at the discretion of the Events Manager, unless otherwise organised.
5 Payment in Full:
Wedding function are required to be paid in full, according to the confirmed final numbers, no less than seven [7] days prior to the confirmed wedding date.
Other functions are required to be paid in full no less than five [5] days prior to confirmed event date unless otherwise arranged.
6 Cancellation/ no show:
Cancellations with in six months of event date will not be refunded.
Cancellations 6-12 months prior to the event date will receive a 50% deposit refund
Cancellations 12-18 months prior the event date will receive a 75% deposit refund.
Cancellations more than 18 months prior will receive a 10% deposit refund.
7 Cleaning and damages:
The client will be held responsible for any extra costs incurred from damages caused, extra cleaning required or replacement of property due to decorations, external suppliers or negligent behaviour by guests.
8 Storage:
Bluewater Bar & Grill does not accept any responsibility for damages to loss of personal belongings/merchandise left on premises prior to, during or after a function.
9 Responsible serving of Alcohol:
Bluewater Bar & Grill practices responsible service of alcohol. Our policy is to serve our guests in a responsible and professional manner at all times, this policy is communicated to function organizers and guests accordingly.
